Website Management Terms & Conditions

COMPANY INFORMATION


1. SERVICE OVERVIEW

Maverik Labs provides comprehensive website management services including website design, development, hosting, domain management, SEO optimisation, analytics monitoring, and ongoing maintenance ("the Service").


2. PAYMENT TERMS

2.1 Monthly Fee: As displayed at checkout and confirmed in your Stripe payment receipt.

2.2 Payment Method: Automatic monthly billing via Stripe on the same date each month.

2.3 Currency: All payments in GBP (£) unless otherwise specified.

2.4 Failed Payments: Service may be suspended after 7 days of failed payment. Reconnection fee may apply.

2.5 Price Changes: 30 days written notice required for any price increases.


3. CONTRACT TERM

3.1 Minimum Term: 12 months from service commencement date.

3.2 Auto-Renewal: Service automatically renews monthly after minimum term unless cancelled.

3.3 Service Commencement: Work begins within 48 hours of payment confirmation.


4. CANCELLATION RIGHTS (UK CONSUMER CONTRACTS REGULATIONS 2013)

4.1 14-Day Cooling-Off Period: You have the right to cancel within 14 days of subscribing without giving a reason. However, as our service begins immediately upon payment, you acknowledge that cancellation during this period will incur charges for work completed.

4.2 Express Consent: By proceeding with payment, you expressly request that we begin performance immediately and acknowledge that you lose your right to a full refund if you cancel after we have begun work.

4.3 After 14 Days: 30 days written notice required via email to website-ops@maveriklabs.com. Service continues until the end of current billing period.


5. SERVICE DELIVERY

6. CLIENT RESPONSIBILITIES

6.1 Content Provision: Client must provide all content, images, and information required for website development within 14 days of service commencement.

6.2 Content Accuracy: Client is responsible for accuracy and legality of all content provided.

6.3 Timely Feedback: Client must provide feedback within 7 days of review requests to avoid project delays.

6.4 Domain Access: Client must provide necessary domain and hosting access credentials if transferring existing websites.


7. INTELLECTUAL PROPERTY

7.1 Client Content: Client retains ownership of all content, images, and materials provided.

7.2 Website Design: Upon full payment of minimum term, client receives ownership of custom website design elements created specifically for their project.

7.3 Third-Party Elements: Some design elements may use licensed templates or frameworks with their own usage terms.


8. REFUND POLICY

8.1 Cooling-Off Period: Refund available minus charges for work completed during 14-day period.

8.2 After Minimum Term: No refunds for future periods after valid cancellation notice.

8.3 Pro-Rata Refunds: Not available for partial months.

8.4 Failed Service Delivery: Full refund available if we fail to deliver agreed services within reasonable timeframe.


9. LIABILITY AND WARRANTIES

9.1 Service Availability: We aim for 99.9% uptime but cannot guarantee uninterrupted service.

9.2 Limitation of Liability: Our liability is limited to the amount paid for services in the 3 months preceding any claim.

9.3 Excluded Damages: We are not liable for indirect, consequential, or loss of profit damages.

9.4 Data Backup: We maintain regular backups but recommend clients maintain their own backup copies.

9.5 Security: We implement reasonable security measures but cannot guarantee complete protection against all cyber threats.


10. DATA PROTECTION AND PRIVACY

10.1 Privacy Policy: Our handling of personal data is governed by our Privacy Policy available at maveriklabs.com/privacy-policy

10.2 GDPR Compliance: We process personal data in accordance with UK GDPR requirements.

10.3 Data Retention: Client data retained for duration of service plus 12 months unless deletion requested.

10.4 Third-Party Services: We may use third-party services (hosting, analytics) with their own privacy policies.


11. TERMINATION

11.1 Termination for Cause:

We may terminate immediately for:

12. FORCE MAJEURE

We are not liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet service provider failures, or cyber attacks.


13. GOVERNING LAW AND DISPUTES

13.1 Governing Law: These terms are governed by the laws of England and Wales.

13.2 Jurisdiction: Courts of England and Wales have exclusive jurisdiction.

13.3 Alternative Dispute Resolution: We encourage resolution through direct communication before formal proceedings.

13.4 Small Claims: Disputes under £10,000 may be resolved through Small Claims Court.


14. GENERAL PROVISIONS

14.1 Entire Agreement: These terms constitute the entire agreement between parties.

14.2 Amendments: Changes must be agreed in writing.

14.3 Severability: If any provision is unenforceable, remaining provisions continue in effect.

14.4 Assignment: We may assign this agreement; client may not without written consent.

14.5 Notices: All notices must be sent to legal@maveriklabs.com for us, and to client's registered email address.


15. STRIPE PAYMENT PROCESSING

15.1 Payment Processor: Payments processed by Stripe, Inc. Subject to Stripe's Terms of Service.

15.2 Payment Security: Card details processed securely by Stripe; we do not store payment information.

15.3 Billing Disputes: Contact us first for billing queries; chargebacks may result in service suspension.

15.4 Subscription Management: Changes to payment methods through customer portal or by contacting support.


16. ACCEPTANCE OF TERMS

By completing payment through Stripe, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You confirm you are authorised to enter into this agreement and that all information provided is accurate.


For business customers: You confirm you are purchasing this service for business purposes and may not be entitled to the same consumer protections.
